Privacy Policy
GetBeezy Privacy Policy Last modified: May 15th, 2009 At GetBeezy, we value your privacy in the highest regard. This privacy policy applies to your use of GetBeezy’s websites (www.FindMeSpecials.com, www.FindMeEvents.com, www.FindMeSpots.com, www.GetBeezy.com) and mobile applications (collectively, the "Sites"), but not does apply to any third party sites that may be linked to this one, or any relationships you may have with the business listed on the Sites. The terms "we", "us", and "GetBeezy" refer to GetBeezy, LLC. The terms "you" and "your" refer to you, as a user of the Sites. The term "personal information" means information that you provide us which personally identifies you, such as your name, phone number, email address, and any other data that is tied to such information. BY USING THE Sites, YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THESE TERMS, YOU SHOULD NOT USE THE Sites. I. Information We Collect and How We Use It We use commercially reasonable efforts to ensure that the collection of personal information is limited to that which is necessary to fulfill the purposes identified below. If we use your information in a manner different than the purpose for which it is collected, then we will ask you for your consent prior to such use. There are two types of information: personal information you knowingly choose to disclose that is collected by us and Sites use information collected by us as you interact with our Sites. Account information. If you create an account with GetBeezy to take advantage of the full range of services offered on the Sites, we ask for and record personal information such as your name and email address, your address, your gender, schools attended and any other personal or preference information. We use your email address to send you updates and news, and contact you on behalf of other users (such as other users who send you shout outs, personal messages, shared items, invitations or favorite reviews). You may choose not to receive e-mail of this type by accessing the "Settings" tab on the Sites and updating your notification settings. Submissions. We record and may publicly display your submissions in order to provide the services that we offer. When we display your submissions, we do so together with your account name (first name and last name). The term "submissions" refers to the information that you submit or post to the Sites for public display, such as business ratings, business location photos, reviews, public event photos, public event descriptions, shout outs, and the information that you display as part of your account’s public profile. Feedback. If you contact us to provide feedback, register a complaint, or ask a question, we will record any personal information and other content that you provide in your communication so that we can effectively respond to your communication. Personal relationships and messaging. When you use the Sites, you may set up your personal profile, form relationships, send messages, perform searches and queries, form groups, set up events, create pages, create chapters, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, in order to allow you to send and receive personal messages to other registered users of the Sites, we record the messages that you send and receive using the Sites's personal messaging feature. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information. Activity. When you enter the Sites, we collect your browser type and IP address. This information is gathered for all Sites visitors. We record information relating to your use of the Sites, such as the searches you undertake, the pages you view, requested URL, referring URL, and timestamp information. We use this type of information to administer the Sites and provide the highest possible level of service to you. We also use this information in the aggregate to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Sites. Cookies. We send cookies to your computer in order to uniquely indentify your browser and improve the quality of our service. The term "cookies" refers to small pieces of information that a websites sends to your computer's hard drive while you are viewing the site. We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back to the Sites. Persistent cookies can be removed by following your browser help file directions. If you choose to disable cookies, some areas of the Sites may not work properly. Content Risks. You post User Content (as defined in the GetBeezy Terms of Use) on the Sites at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Content you post on the Sites will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content. Profile Information. When you register, you create your own profile and privacy settings. Your profile information, as well as your name, email and photo, are displayed to people in the networks specified in your privacy settings to enable you to connect with people on GetBeezy. If you choose, we may occasionally use your name and email address to send you notifications regarding new services offered by Facebook that we think you may find valuable. Profile information is used by the Sites primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings. In some cases where your privacy settings permit it (e.g., posting to your wall), other GetBeezy users may be able to supplement your profile. Profile information you submit to the site will be available to users of GetBeezy who belong to at least one of the networks you allow to access the information through your privacy settings (e.g., school, geography, friends, or friends of friends). Your name, network names, and profile picture thumbnail will be available in search results across the GetBeezy network and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. People who see your name in searches, however, will not be able to access your profile information unless you have set permissions in your privacy settings to allow people with a certain relationship to you (friend of friend, member of your networks, etc.) to access said information. Enforcement. We may use the information we collect in connection with your use of the Sites (including your personal information) in order to investigate, enforce, and apply our Terms of Service and Privacy Policy. We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Sites service or using the GetBeezy name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies. Any improper collection or misuse of information provided the Sites is a violation of the GetBeezy Terms of Service and should be reported to privacy@getbeezy.com. II. Transfer of Information We may distribute your Submissions to third parties, as permitted pursuant to our Terms of Service. The third parties may in turn publicly display or publish your submissions in connection with their own websites and media platforms. When we distribute your submissions to third parties, we typically include your account name (but not your personal information unless you include your personal information in your Submission). GetBeezy will allow third party search engines “crawlers” to access certain information that you deem public, namely Submissions. Apart from submissions, GetBeezy will block access beyond your name, profile picture, and limited aggregated data about your profile (e.g. number of pad postings). Your feed may aggregate the information you provide and make it available to your friends and network members according to your privacy settings (default is set to friends only). If you do not want information to show on the feed, you can choose to create private pages and events that will be invisible except to those you choose to view those pages. We may share your personal information with third parties to provide you with services that we offer through the Sites, conduct quality assurance testing, facilitate creation of accounts, provide technical and customer support, or provide specific services, such as synchronization of your contacts with other software applications, in accordance with your instructions. These third parties are required not to use your personal information other than to provide the services requested by you. We may share your personal information with our parent company, subsidiaries, joint ventures, or other companies under a common control (collectively, "Affiliates") that we may have now or in the future, in which case we will require them to honor this Privacy Policy. If another company acquires our company or our assets, that company will possess your personal information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy. We may disclose your personal information to third parties in a good faith belief that such disclosure is reasonably necessary to (a) take action regarding suspected illegal activities; (b) enforce or apply our Terms of Service and Privacy Policy; (c) comply with legal process, such as a search warrant, subpoena, statute, or court order; or (d) protect our rights, reputation, and property, or that of our users, affiliates, or the public. Please note that we are not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that we receive. We may disclose information in the aggregate to third parties relating to user behavior in connection with actual or prospective business relationship with those third parties, such as advertisers and content distributors. GetBeezy will do this without identifying you as an individual to third parties. For example, we may disclose the number of users that have been exposed to, or clicked on, advertising banners. Another example would be aggregating how many people in a network like a band or restaurant and personalizing advertisements and promotions so that we can provide you with a better service. We believe this benefits you. By using the Sites, you are consenting to have your personal data transferred to and processed in the United States. III. Others' Information GetBeezy allows you to tag people to beezness pages and photos before they are signed up to the site in order to enhance their introduction to the Sites. When you want to add an unregistered friend to a page, photo or to invite that friend to the Sites, we will ask you to provide us with that person’s email address, first name and last name. We contact that person when you choose and send out an invitation to the Sites and, if desired, remind that person about the invitation. The Sites stores this information to register a friend connection if your invitation is accepted, to add that friend to pages that they were tagged in, to request confirmation to photos that they were tagged in, and to track the success of our referral program. By providing us with another person's e-mail address, you represent to us that you have obtained the consent of the person concerned as regards such disclosure to us of their personal information. All invitees are provided with the option not to receive further invitations. Your friend may contact us at pissed@getbeezy.com to request that we remove this information from our database. We may disclose such information if required to do so in order to comply with legal process, as described above. IV. Links This Sites may contain links to third party websites to which we have no affiliation. Except as set forth herein, we do not share your Personal Data with those third parties, and are not responsible for their privacy practices. We suggest you read the privacy policies on all such third party websites. This Privacy Policy applies solely to information collected by the Sites. V. Third Party Advertising Advertisements that appear on the Sites are sometimes delivered (or "served") directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. The Sites does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on the Sites unless you choose to share it with them. This privacy policy covers the use of cookies by the Sites and does not cover the use of cookies or other tracking technologies by any of its advertisers. VI. Controlling Your Personal Data To the extent you include personal information in your submissions (such as a photo of yourself), third parties may be able to identify you, associate you with your user account, and contact you. Third parties can also associate you with your user account using the member lookup feature on the Sites, but only if the third party already knows your full name and you include information in your submission that allows the third party to distinguish you from other users who might share the same full name. Please do not include information in your submissions that you expect to keep private. When you use the Sites, certain information you post or share with third parties (e.g., a friend or someone in your network), such as personal information, comments, messages, pages, chapters, photos, videos, or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, pages, chapters, photos, videos, listings or other items, this information may become publicly available. Please also note that the personal messages you send or receive using the Sites's personal messaging feature are only private to the extent that you and the sender/recipient keep them private. For example, we do not have any control over whether a recipient of one of your personal messages publicly posts the contents of such a message. Access and control over most personal information on the Sites is readily available through the profile editing tools. GetBeezy users may modify or delete any of their profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to deactivate their GetBeezy account may do so on the My Account page. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to members of GetBeezy. Where you make use of the communication features of the service to share information with other individuals on the Sites, however, (e.g., sending a personal message to another GetBeezy user) you generally cannot remove such communications. As a registered GetBeezy user, you can modify some of your personal information and your privacy preferences by accessing the "Settings" section of this website. For example, you may choose not to receive e-mail solicitations from GetBeezy by accessing the "Setting" tab on the Sites and updating your notification settings. Also, upon your request, GetBeezy will use commercially reasonable efforts to close your account, and cease displaying your submissions on the Sites; nevertheless, we may still retain your personal information in our systems. Registered users who wish to close their account should click here. VII. Security Your account is password protected. We use industry standard measures to protect the personal information that is stored in our database. We limit the access to your personal information to those employees and contractors who need access to perform their job function, such as our customer service personnel. If you have any questions about the security on the Sites, please contact us. Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that your personal information will never be disclosed in a manner that is inconsistent with this Privacy Policy. If you have any questions about the security of GetBeezy Web Sites, please contact us at privacy@getbeezy.com You hereby acknowledge that GetBeezy is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner. VIII. E-mails and Opt-out You may opt-out of receiving personal messages from specific users. In addition, you may opt-out of receiving notifications from us by changing your notification settings under the "Settings" tab after you log on to this website. Unregistered users who receive e-mails from us may also opt-out of receiving further e-mails by following the instructions contained in our e-mails. Despite your indicated e-mail preferences, we may send you notices of any updates to our Terms of Use or Privacy Policy. IX. Terms and Modifications to this Privacy Policy Your use of the Sites, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law. We may modify this Privacy Policy at any time, and we will post any new versions on this page If we make material changes to this policy, we will notify you here, by email, or through notice on our home page. We encourage you to refer to this policy on an ongoing basis so that you understand our current privacy policy. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account. Please note that at all times you are responsible for updating your personal information to provide us with your most current e-mail address. In the event that the last e-mail you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. In any event, changes to this Privacy Policy may affect our use of Personal Data that you provided us prior to our notification to you of the changes. If you do not wish to permit changes in our use of your personal information, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us. Continued use of the Sites following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes. X. Access requests should be sent to our Privacy Officer, using the contact information above. When requesting access to your personal information, we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide the personal information that we hold about you. We may charge you a fee to access your personal information to cover our costs; however, we will advise you of any fee in advance.
